SOBER-EYE INC. ("Sober-Eye") is committed to protecting the privacy and security of users' personal information. This Privacy Policy explains how we treat personal information about the users that we receive in connection with the Sober-Eye Enterprise mobile application and the Sober-Eye Enterprise website (the "Online Service").
Please note that use of the Online Service is governed by the Sober-Eye Terms and Conditions of Use (the "Terms of Use") and the Sober-Eye End User License Agreement ("EULA") available at   www.sobereye.com/terms-of-service. The servers for the Online Service are located in the USA, and any personal details are provided to us will be processed by Sober-Eye in the USA.  Sober-Eye expressly excludes any representation or warranty, express or implied, with respect to the information available on the Online Service.  Sober-Eye makes no representation about any third-party websites that may be accessed via links from the Online Service.  By using the Online Service, users agree that the laws of the State of California, without regard to its conflict of laws principles, will govern all matters between the users and Sober-Eye with respect to users use of the Online Service.  
This policy applies only to information we collect through the Online Service.  This policy DOES NOT apply to information that we collect offline, ratings or reviews that users may submit regarding the Online Service ("User Submissions") or that users provide to or is collected by any third party.  Other websites, applications and third parties may have their own privacy policies.  We encourage the users to read them before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding the users information and how we will treat it. By downloading, installing or using the Online Service, users agree to this Privacy Policy. 
This policy may change from time-to-time.  Users continued use of the Online Service after we make changes signifies the users' acceptance of those changes. 
 
Information We Collect
We will collect various items of personal information from the users only if voluntarily submitted by the users or by the organization to whom the users belong for purposes such as requesting or accessing information, products, or services; using features to provide your current location for receiving certain localization services; or requesting technical assistance or reporting a problem with the Online Service.  The types of information that we may collect include users' name, address, email address, phone number(s), gender, age, and location, and any other information that the users or the organization to whom the users belong decide to provide us voluntarily.
Sober-Eye disclaims any legal duty to verify the accuracy of any personal data that the users or the organization to whom the users belong provide to Sober-Eye.   
Users may also provide information to be published or displayed on public areas of the Online Service ("User Submissions") that will be posted and transmitted to others at users' own risk.  Because we cannot control the actions of third parties with whom users may choose to share the User Submissions, we cannot guarantee that the User Submissions will not be viewed by unauthorized persons.  If users delete the User Submissions from the Online Service, copies of the User Submissions may remain viewable in cached and archived pages, or might have been copied and stored by other Application users.

How We Use the Information We Collect and with Whom We Share It 
Unless otherwise specified in this Privacy Policy, Sober-Eye reserves the right to compile, save, use within the scope of our activities, and analyze the information that you provide to us through the Online Service, including through your use of the Mobile App. We may disclose users email address, any personal information that the users or the organization to whom the users belong may voluntarily choose to provide us and/or User Submissions to comply with any court order, law or legal process, including to respond to any government or regulatory request, and to enforce our rights arising from any contracts entered into between the users or the organization to whom the users belong and us, including the EULA and Terms of Use, or if we otherwise believe disclosure is necessary or appropriate to protect the rights, property, or safety of Sober-Eye, our customers or others.
California Civil Code Section 1798.83 permits users of our Application who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.  We do not and will not disclose the users or the organization to whom the users belong personal information to anyone except the users or the organization to whom the users belong (for example, to recover or reset a password) or as disclosed in the paragraph immediately above.  To request confirmation of this particular policy, please send an email to info@sober-eye.com.
 
Choices about Our Collection, Use and Disclosure of Your Information
We strive to provide the users or the organization to whom the users belong with choices regarding the personal information provided to us.  This section describes the mechanisms we provide to control certain uses and disclosures of information.
The users or the organization to whom the users belong may access their email address and any personal information that have been voluntarily shared with us by contacting us by email at info@sober-eye.com.  The users or the organization to whom the users belong may request, at any time, that we modify or delete personal information by sending an email to us with the words "UPDATE SUBSCRIBER INFORMATION" in the subject line. Sober-Eye may take reasonable steps to verify the identity of the users or the organization to whom the users belong before making changes to the personal information.
The users or the organization to whom the users belong can choose whether to allow the Online Service to collect and use real-time information about the device's location through the device's privacy settings.  If the users or the organization to whom the users belong block the use of location information, some parts of the Online Service may then be inaccessible or not function properly.
 
Children's Information and COPPA
We do not knowingly collect personal information from or about children.  The content of our Online Service and the products and services that we provide are not intended for, or directed to, children.  Please do not use or access our Application at any time or in any manner if you are under 17 years of age.
 
Links to Other Sites
For convenience, the Online Service may link to third-party sites whose information practices may be different than ours.  Visitors should consult the other sites' privacy policies, as we have no control over information that is submitted to, or collected by, these third parties.  
 
Security of Information and Disclosures
Sober-Eye uses industry standard security measures to safeguard information concerning and submitted by users.  Despite the security measures that we employ, we cannot guarantee the absolute security of information sent through the Internet and mobile platforms.
Sober-Eye will control the personal information as set forth above to the extent possible.  Except as otherwise set forth in this Privacy Policy, we will not use or disclose personal information.  Although we are committed to maintaining the confidentiality of personal information, if required by law, we reserve the right to disclose such information without first obtaining consent.
 
Changes to this Privacy Policy
This Privacy Policy is subject to change from time-to-time.  If we make material changes regarding how we treat our users' personal information, we will post the new privacy policy on this page at our sole discretion and with or without notice.  The continued use of the Online Service following Sober-Eye's modification of this Privacy Policy constitutes acceptance of the modified Privacy Policy.  If any term or provision of this Privacy Policy is be found to be invalid, illegal or otherwise unenforceable, that finding shall not affect the other terms or provisions of this Privacy Policy, or the whole of this Privacy Policy, but such term or provision shall be deemed modified to the extent necessary to render such term or provision enforceable, and the rights and obligations of the users or the organization to whom the users belong and Sober-Eye shall be construed and enforced accordingly, preserving to the fullest permissible extent the intent and agreements set forth in this Privacy Policy.
